1. Scope and Acceptance of the Terms and Conditions of Sale (TCS)

These Terms and Conditions of Sale (TCS) govern all product sales made via the website www.oravera.fr (hereinafter “the Site”), operated by Maison Oravera, a French artisanal micro-enterprise. Maison Oravera offers handcrafted Mediterranean home fragrances made in France, designed with the highest standards of quality — combining authenticity, refinement, and emotion to elevate your interiors.
These products are intended for private customers residing in mainland France (for deliveries outside this area, please contact us directly).

By placing an order on the Site, the Customer (a natural person of legal age purchasing for non-commercial purposes) accepts these TCS without reservation.
Maison Oravera reserves the right to modify the TCS at any time; however, the applicable conditions are those in effect on the date the order is placed.

2. Products

Maison Oravera designs and sells high-end artisanal home fragrances inspired by the Mediterranean.
Each fragrance is described in detail on the Site (olfactory notes, size, usage tips, etc.), accompanied by non-contractual photographs.
While we take the utmost care in presenting our products, the artisanal nature of our production means slight variations may occur between batches (e.g. label shade, packaging texture). These minor variations — signs of authenticity — do not affect product quality and cannot be considered defects.
Due to screen settings, actual colors may also slightly differ from those displayed online.

All products are offered subject to availability. In the event of an exceptional stock shortage after an order is validated, the Customer will be informed promptly and may choose between a refund, a later delivery date (if restock is expected), or a substitute item of equal value. Maison Oravera cannot be held liable for unavailability but will always strive to propose a satisfactory solution.

3. Orders

Placing an order on oravera.fr is simple and secure. The Customer must follow these steps:

  1. Product selection: Browse the shop and add desired items to the cart.

  2. Cart review: Verify product details, quantities, and prices. Adjust before checkout if needed.

  3. Customer information: Log in or enter delivery and billing details (name, full address, email, phone number).

  4. Delivery method: Choose between available options (Colissimo, Mondial Relay, etc.).

  5. Payment method: Select a payment option (see section 5).

  6. Acceptance: Tick the box confirming you’ve read and accepted the present TCS.

  7. Payment: Complete payment through our secure platform.

Once payment is validated, a confirmation email summarizing the order (items, quantities, total price, delivery fees, address, etc.) will be sent to the Customer.
Maison Oravera reserves the right to refuse or cancel any order deemed irregular (e.g. unresolved payment dispute, suspected fraud, unusually large quantities for personal use). The Customer will be informed and refunded if applicable.

Customers are responsible for the accuracy of their provided information. Maison Oravera cannot be held responsible for delays or failed deliveries caused by incorrect addresses. Any re-shipment due to such error will be charged to the Customer.

4. Product Prices

Prices are indicated in Euros (€), all taxes included.
As a micro-enterprise, Maison Oravera is not subject to VAT (Article 293 B of the French General Tax Code); thus, no VAT is applied.

Prices in force at the time of order validation apply. Maison Oravera reserves the right to adjust its prices at any time but commits to honoring the rates shown at checkout (except in case of obvious typographical error). Delivery costs are not included in product prices and are shown separately during checkout.

Promotional codes or discounts are applied according to their stated terms (validity period, eligible items, etc.).

5. Payment Terms

Full payment (including shipping) is due at checkout. No order will be shipped until payment has cleared.

Accepted secure payment methods include:

  • Credit/Debit Card: Visa, MasterCard, and other cards supported by our secure payment partner.

  • PayPal: Quick and secure checkout using your PayPal account.

  • (Other options such as Apple Pay or Google Pay may be available via Shopify.)

All transactions are encrypted using SSL technology. Maison Oravera does not store any payment data.

If payment is declined (e.g. insufficient funds, reported card theft, exceeded limit), the order will be canceled. Maison Oravera bears no responsibility for any fees charged by the Customer’s bank.

6. Delivery

6.1 Methods & Coverage
Delivery is available throughout mainland France. Customers may choose between:

  • Colissimo (La Poste): Home delivery or post-office pickup.

  • Mondial Relay: Delivery to a selected local pickup point.

6.2 Preparation & Dispatch Times
Orders are generally prepared within 1–2 business days after validation (excluding weekends and holidays). During busy seasons, delays may slightly increase.
Once dispatched, a confirmation email including a tracking number is sent.

6.3 Delivery Times & Fees
Indicative transit times:

  • Colissimo: 2–3 business days after dispatch.

  • Mondial Relay: 3–5 business days after dispatch.

Shipping costs are calculated automatically and displayed before final confirmation. Maison Oravera may offer free shipping above a specified purchase amount, indicated on the Site.

6.4 Receipt
Customers must check parcels upon delivery. If damaged or opened, report it to the carrier immediately and contact us.
Maison Oravera is not liable for delays caused by carriers or force-majeure events (strikes, weather, etc.) but will assist in resolving any issue.

7. Right of Withdrawal & Returns

7.1 Legal Right of Withdrawal
In accordance with French Consumer Law, customers have 14 calendar days from receipt to withdraw from the purchase without reason or penalty.
The request must be sent before the end of this period — ideally by email to contact@oravera.fr.

Exceptions:
The right of withdrawal does not apply to:

  • Customized or made-to-order products.

  • Products unsealed after delivery for hygiene or health reasons (e.g. opened fragrance bottles).

7.2 Return Procedure
Returned products must be unused, unopened, and in their original packaging within 14 days after withdrawal notification.
Unless otherwise instructed, return to:
Maison Oravera – 7 rue des Clairs Bassins, 58400 La Charité-sur-Loire, France.
Return costs are the customer’s responsibility (unless the return is due to our error).

7.3 Refund
Refunds are issued within 14 days of receiving the returned goods (or proof of shipment). Payment is made through the original method used.
Maison Oravera may refuse or adjust refunds for damaged or opened products not meeting return conditions.

8. Legal Warranties

Products are covered by:

  • Legal Guarantee of Conformity (French Consumer Code L217-3 to L217-20): Valid for 2 years from delivery.

  • Guarantee Against Hidden Defects (Civil Code 1641 to 1649): Valid for 2 years from discovery of defect.

In case of defect, contact contact@oravera.fr with photos and a description. We will arrange repair, replacement, or refund as appropriate.
Guarantees do not cover misuse, neglect, or normal wear.

9. Liability

Maison Oravera has a best-effort obligation in online sales. We are not liable for indirect damages or for delays caused by external circumstances or force majeure.
Maison Oravera is not responsible for misuse or professional use of its products, nor for damages linked to Internet use (data loss, viruses, etc.).

10. Personal Data & Privacy

Customer data collected during the order process are handled in compliance with the GDPR.
Customers have rights to access, rectify, delete, or oppose their data processing (see our Privacy Policy).

11. Governing Law & Dispute Resolution

These TCS are governed by French law.
In case of dispute, the Customer should first contact our support at contact@oravera.fr to seek an amicable solution.

If unresolved, disputes fall under the jurisdiction of French courts.
Consumers may also refer to an approved mediation service or use the EU Online Dispute Resolution platform: https://ec.europa.eu/consumers/odr/.

12. Final Provisions

If any provision is found invalid or unenforceable, the remaining clauses remain in effect.
Failure by Maison Oravera to enforce any clause does not constitute a waiver of its rights.
